Terms of Service
These Terms of Service (the "Terms") set out the conditions for using "DokimiAI" (the "Service"), an AI virtual try-on service for online stores provided by WPKNET Inc. (ζ ͺεΌδΌη€Ύγγγ«γγΌγ±γΌγγγ) (the "Company"). Shop operators who use the Service (the "User") shall use it in agreement with these Terms.
Article 1 (Scope)
These Terms govern the conditions for providing the Service and the rights and obligations between the Company and the User, and apply to all matters relating to the use of the Service between the User and the Company.
Article 2 (Definitions)
- "Plugin" means the software the Company provides to run the Service on WordPress / WooCommerce.
- "Installation code" means the script tag and related code (including widget.js) that the Company issues to install the Service on an online store.
- "API key" means the identifier the Company issues to authenticate the plan and to enable use of the Service's features (including the site key).
- "End user" means a consumer who views or uses the User's shop.
Article 3 (Account and API key)
- The User shall keep their registered information accurate and up to date.
- The User shall manage the API key strictly at their own responsibility and may not disclose, lend, or transfer it to any third party.
- The User shall be responsible for any damage arising from inadequate management of the API key, use by a third party, or the like.
Article 4 (Plans, fees, payment, cancellation, and refunds)
- The Service offers Free / Pro / Business / Enterprise plans, which differ in features and in the maximum number of products for which try-on can be enabled.
- Fees for paid plans are paid monthly in advance by credit card (Stripe).
- Paid plans renew automatically every month and are charged automatically on each monthly billing date unless canceled.
- Each subscription covers one site (one domain).
wwwand non-wwware treated as the same site. Use on a different site (including a subdomain) requires a separate subscription for each site. - Paid plans can be canceled at any time from "Billing" in the DokimiAI console (console.dokimiai.io), or from the "Manage subscription" button in the DokimiAI settings of the WordPress dashboard (both open the Stripe billing management page). Even after canceling, the User may continue to use the Service until the end of the current billing period (the next renewal date).
- After cancellation, no charges occur from the next renewal date onward. No prorated refund is provided for the unused period.
- Due to the nature of digital services, fees already paid after payment completion are, in principle, non-refundable. However, if a serious defect attributable to the Company prevents provision of the service, the Company will handle it individually.
Article 5 (Prohibited acts)
When using the Service, the User shall not engage in any of the following acts.
- Acts that violate laws or public order and morals
- Acts that infringe the intellectual property, privacy, reputation, or other rights of the Company or any third party
- Reverse engineering, modifying, or redistributing the Plugin or the Installation code, or misusing the API key
- Acts that interfere with the operation of the Service or place an excessive load on it
- Registering false information
- Other acts that the Company deems inappropriate
Article 6 (Intellectual property)
Copyright and other intellectual property rights relating to the Service, the Plugin and the Installation code belong to the Company or its rightful holders. These Terms grant the User a right to use the Service and do not transfer any intellectual property rights.
Article 7 (Changes, suspension, and termination of the Service)
The Company may change the contents of the Service or terminate its provision upon prior notice to the User. In unavoidable cases such as system maintenance, failures, or force majeure, the Company may temporarily suspend the Service without prior notice.
Article 8 (Disclaimer)
- The try-on feature is only a reference image of how an item looks when worn; the Company does not warrant any difference from the actual product's color, size, or texture.
- The Company does not warrant that the Service fits the User's particular purpose, has the expected functions, accuracy, or usefulness, or is free of defects.
- Except in cases of the Company's intent or gross negligence, the Company is not liable for any damage incurred by the User or end users from using the Service.
- Even where the Company bears liability for damages, the scope shall be capped at the total amount of fees the User paid to the Company in the most recent 12 months.
Article 9 (Changes to these Terms)
The Company may change these Terms upon notice to the User when it deems necessary. If the User uses the Service after a change, the User is deemed to have agreed to the changed Terms.
Article 10 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan, and any dispute arising between the Company and the User in connection with the Service shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.
